Council is seeking feedback on a Planning Proposal at 99-117 Birrell Street, Waverley.

Background

This Planning Proposal proposes an amendment to the Local Environmental Plan that will result in changes to the planning controls of 99-117 Birrell Street, Waverley. The Planning Proposal has been prepared by Council, as a result of a request made by the applicant (Ethos Urban on Behalf of Uniting).

This Planning Proposal complements the Planning Proposal at 125 Birrell Street, Waverley (known as the War Memorial Hospital – Campus Site Planning Proposal) exhibited 20 May - 04 July 2021.

This Planning Proposal was supported by Council at the November 2020 Strategic Planning and Development Committee and was submitted to the DPIE for assessment. Council received a Gateway Determination (approval to go on exhibition) from the DPIE in September 2021.

The Planning Proposal for 99-117 Birrell Street, Waverley will be accompanied by a site-specific Development Control Plan (DCP), which will provide specific design guidance to any future development in relation to; building design, building layouts, building setbacks, relationship with nearby heritage items, waste management, parking and traffic management, landscaping and urban ecology.

Council previously sought feedback on a draft site-specific DCP between 20 May– 4 July 2021. Council Officers are currently reviewing the draft site-specific DCP with regards to both the feedback received, and in-line with a Council resolution at the 17 August 2021 Council Meeting. This matter will be reported to Council at a later date, following the completion of the review.

The proposal

The Planning Proposal put forward changes to the planning controls for the site and amends the Waverley Local Environment Plan 2012 to:

  • Create an incentivised Alternative Building Heights of 15m and 21m.
  • Create an incentivised Alternative Floor Space Ratio of 1.2:1

The incentive building heights and floor space ratio will only be available on the site on the basis that:

  • Clause 6.9 Design Excellence in the Waverley Local Environmental Plan 2012 applies,
  • affordable housing which amounts to either 10% of any dwellings or 404 square metres (whichever is greater) is provided as part of any redevelopment on the site, and
  • any future development is provided to a high-performance building standard, to demonstrate best-practice sustainability by reducing water and energy usage on-site and minimising embodied carbon.

The intention of the proposal is to:

  • provide essential social infrastructure for health-related uses and seniors housing,
  • retain and enhance the unique heritage and environmental significance of the site, and
  • open the site up to the public to encourage a greater level of community engagement with the heritage fabric and open space on the site.

Feedback received on the Planning Proposal during the public exhibition period will be reviewed by Council Officers before being reported to Council in the first half of 2022, should you provide feedback, you will be provided with an update when the matter is reported to Council and following the decision of Council.

    Site-specific Development Control Plan

    A site-specific Development Control Plan has been prepared to support the two planning proposals for the Campus Site and Birrell Street Site.

    This draft site-specific DCP aims to provide detailed provisions that guide development on the site known as the Edina Estate to ensure balanced social and environmental outcomes.

    Council Officers are reviewing the draft site-specific DCP with regards to both the feedback received, and in-line with a Council resolution at the 17 August 2021 Council Meeting. This included matters relating to the management of heritage, urban ecology and habitat corridors, building setbacks and footprints, pedestrian access through the site, and traffic and parking management. The site-specific DCP will be reported to Council at a later date, following the completion of the review.

    Planning Proposal: Waverley War Memorial Hospital Campus Site

    The planning proposal sought to amend the Waverley Local Environmental Plan 2012 to:

    • provide specific objectives for the site redevelopment
    • allow seniors housing, community facilities and a centre-based childcare facility as an additional permitted use, in parts of the site where this is not currently permitted
    • apply Clause 6.9 Design Excellence from the existing Waverley Local Environmental Plan
    • set out the requirements of a site-specific DCP
    • provide allowances for an increased maximum building height of 15m and 21m and an increased maximum floor space of 1.2:1, based on:
      • the site having a minimum of 30% area where deep soil is provided, which would require the provision of a landscaped area that is planted and permeable — allowing for the retention and planting of mature trees where appropriate and contributing to the reduction of stormwater runoff to urban areas
      • any future development to be provided to a high-performance building standard, to demonstrate best-practice sustainability by reducing operational water and energy usage on-site and minimising embodied carbon.

    Following the public exhibition period, the Planning Proposal was reported to Council on the 17 August 2021. The recommendation for Council to support the Planning Proposal was endorsed at the meeting and the Planning Proposal was sent to the Department of Planning, Industry and Environment (DPIE) who, as the Plan Making Authority, were responsible for undertaking the post-exhibition review and finalising of the Planning Proposal.
